1. Services
FairAssess, Inc. ("FairAssess," "we," "us") provides property tax appeal preparation and filing services for residential property owners in supported states. We are not a law firm and do not provide legal advice. Our services are administrative appeals before county appraisal authorities.
2. Eligibility
You must be the property owner or an authorized agent with legal authority to appeal on behalf of the owner. You must provide accurate contact and property information. Services are available only in states and counties where FairAssess actively operates.
3. Estimates
Savings estimates displayed on our website are illustrative projections based on public records and comparable sales data. They are not guarantees of appeal outcomes or final tax savings. Actual results depend on county decisions, market conditions, and property-specific factors.
4. Membership & pricing
Membership is billed annually at one flat annual fee depending on your estimated savings tier, shown before checkout. Payment is processed by Stripe. Membership covers one appeal cycle for the tax year in which you enroll unless otherwise stated.
5. Guarantee
If we don't reduce your property tax assessment, we'll refund your full membership fee — no questions asked. Refunds are issued to the original payment method within 10 business days of the county's final determination for the covered tax year. The guarantee applies only when FairAssess files a complete appeal on your behalf during your active membership period.
6. Your responsibilities
You agree to provide truthful information, respond to our requests in a timely manner, and notify us of any changes affecting your property or ownership. Delays caused by incomplete information may affect our ability to meet county deadlines.
7. Limitation of liability
To the maximum extent permitted by law, FairAssess's total liability for any claim arising from our services is limited to the membership fees you paid for the appeal tax year in question. We are not liable for indirect, incidental, or consequential damages, including lost tax savings beyond refunded fees.
8. Disputes
These terms are governed by the laws of the State of Texas. Disputes shall be resolved through binding arbitration in Travis County, Texas, except where prohibited by law. You waive the right to participate in class actions to the extent permitted.
9. Changes
We may modify these terms by posting an updated version on this page. Continued use after changes constitutes acceptance. Material changes to active memberships will be communicated by email.
